Payhere Inc. (the “Company”) values the Personal Data of its members (“you, your, yours”) and complies with relevant laws and regulations. Through this Privacy Policy (the “Privacy Policy”), the Company informs you of the purpose and manner of the use of the Personal Data you provide, and what measures are being taken to protect Personal Data.

If the Company revises the Privacy Policy, it will announce such revisions through the Company’s website announcement (or individual announcement).

1. Scope of Application

The Privacy Policy applies to mobile applications and websites provided by the Company, as well as worldwide products, functions, and other services operated by the Company (collectively, the “Services”).

2. Collection of Personal Data

The Company collects your email addresses and trade names.

  1. Items in which Personal Data items can be automatically generated and collected in the course of using the Services: Service usage records, visit records, payment records, access dates and times, IP addresses, MAC addresses, device types, OS types and versions, and push tokens.

3. Protection of Children’s Personal Data

The Company’s services are limited to individuals aged 18 or older. The Company does not allow individuals under the age of 18 to use the Services.

4. Use of Personal Data

The Company uses the collected Personal Data for the purposes listed below. Personal Data will not be used for any purpose other than the listed purposes. If there is any change to the purpose of use, necessary measures such as obtaining separate consent will be taken.

1) Membership Registration and Management: Identification and authentication of the information subject following the provision of membership-based services, prevention of members’ wrongful use and unauthorized use, preservation of records for dispute mediation, handling of complaints, and matters to be notified

2) Provision of Services: Performance of contracts for the provision of the Services, personal authentication

3) Utilization for Marketing and Advertisement: Information on the delivery of advertising information such as new services (products) or events, provision of the Services based on demographic characteristics, advertisement posting and analysis data provision, identification of frequency of access, or statistics on the use of the Services by members

In principle, once the purpose of collecting and using Personal Data is achieved, the Company destroys the relevant information without delay. Provided, however, that if there is a necessity to preserve the information pursuant to the relevant laws and regulations, the Company keeps member information for a certain period of time as prescribed.

5. Period of Retention and Use of Personal Data

1) The Company, in principle, handles and retains Personal Data within the period of retention and use of Personal Data in accordance with laws and regulations or within the Personal Data retention and usage period agreed upon when collecting Personal Data from the data subject.

2) The Company immediately destroys the collected Personal Data if you withdraw your consent or membership, the purpose of collection and use of the Personal Data is achieved, such as completion of service provision, and completion of payment and settlement of accounts.

6. INTERNATIONAL TRANSFERS OF PERSONAL DATA

Your Personal Data may be transferred from the country, state and city (“Home Country”) in which you are present while using the Company’s Services to another country, state and city (“Alternate Country”).

When the Company transfers your Personal Data from your Home Country to the Alternate Country, the Company will comply with its legal and regulatory obligations in relation to your Personal Data, including having a lawful basis for transferring Personal Data and putting appropriate safeguards in place to ensure an adequate level of protection for the Personal Data. The Company will also ensure that the recipient in the Alternate Country is obliged to protect your Personal Data at a standard of protection comparable to the protection under applicable laws.

7. Rights of Information Subjects and Legal Representatives and Methods of Exercising Such Rights

1) You can exercise your rights to access, correct, delete, or suspend the processing of Personal Data at any time by means of writing, email, or otherwise informed by the Company.

2) You may exercise the rights under Paragraph 1 through your legal representative or agent such as a person delegated to act on your behalf.

3) The Company will confirm whether the person who made a request to read, correct, delete, or suspend the processing of the Personal Data based on the member rights is the information subject or a duly authorized agent.

8. Procedures and Methods of Destruction of Personal Data

The Company, in principle, once the purpose of collecting and using Personal Data is achieved, will destroy the relevant information without delay. The procedures and manners of the destruction are as follows: After the purpose is achieved, the information you entered during your membership registration will be transferred to a separate DB (in the case of information in paper format, to a separate document box) and will be destroyed after being stored for a certain period according to the Company’s internal policy and other grounds for information protection under the relevant laws and regulations. Personal Data transferred to a separate DB will not be used for any purpose other than retention unless such use is pursuant to law and regulations.

  1. Methods of Destruction

- Personal Data stored in electronic file format is deleted using a technical method that prevents the recovery of the information.

- Personal Data printed on paper is destroyed by shredding the same with a shredder or by incinerating it.

9. Measures to Ensure Personal Data Safety

The Company takes the following measures to ensure the safety of Personal Data:

1) Management measures: Establishment and implementation of internal management plans, regular training for employees, staff, etc.

2) Technical measures: Control of access rights such as encryption of Personal Data processing systems, installation of security programs such as vaccine software, and encryption of files storing Personal Data.

3) Physical measures: Locking of places storing or keeping Personal Data, access control, etc. to such places.

10. Right to Refuse Consent and Disadvantage

You have the right to refuse to consent to the collection and use of your Personal Data as described above. Even if you refuse to consent to the collection and use of information in the optional items, you can become a member. But if you refuse to consent to the collection or use of information in the required items, you cannot become a member because the required items are the minimum information necessary for membership.

12. Notice Following Changes to the Privacy Policy

The Privacy Policy applies from the Effective Date. If there are any additions, deletions, or corrections in accordance with laws and regulations and policies, the Company will notify you through an announcement. Also, if there is an unavoidable change in the Privacy Policy due to changes in relevant laws or company policies, please refer to the notice on the website as the Company strives to notify you as quickly as possible.
